Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Kush Heaven Festival LLC, a California limited liability company (“Kush Heaven,” “we,” “us” or “our”) governing your use of kushheavenfest.com (the “Site”). By accessing or using the Site you accept these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Eligibility
The Site is intended for adults. You must be at least 18 years old to use the Site, and you must be at least 21 years old to attend or seek membership for Kush Heaven Festival. By using the Site you represent that you meet these requirements and that your use complies with the laws of your jurisdiction.
2. The event
- Kush Heaven Festival is a private, members-only, 21+ event scheduled for Saturday, March 20, 2027 at The Concrete Jungle, 1030 Alpine St, Los Angeles, CA. Admission is limited to approved members and their invited guests and is subject to the event rules, venue policies and valid government-issued photo identification.
- Event details, including the date, venue, lineup, schedule and admission requirements, may change. We will post updates on the Site and notify subscribers where practical.
- Nothing on the Site constitutes an offer to sell, or a solicitation to buy, any product or service. The Site does not sell tickets at this time. Any future ticketing or membership program will be governed by additional terms presented at the time of purchase or application.
- To the extent the event involves cannabis or cannabis-related activities, participation is restricted to adults aged 21 and over in accordance with California law. The Site does not sell, deliver or facilitate the sale or delivery of cannabis products, and nothing on the Site is medical, legal or health advice.
- We reserve the right to refuse admission to, or remove from the event, any person who violates the event rules, venue policies or applicable law, or whose conduct is unsafe or disruptive.
3. Intellectual property
The Site and all of its content, including the Kush Heaven Festival name, the winged crest, the “Festival” wordmark, artwork, flyers, photographs, text, graphics, design and code (collectively, the “Content”), are owned by or licensed to Kush Heaven and are protected by United States and international copyright, trademark and other laws. Kush Heaven Festival™ and the winged crest are trademarks of Kush Heaven Festival LLC. All rights reserved.
We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for your personal, non-commercial use. You may share links to the Site. You may not copy, reproduce, modify, distribute, publicly display, create derivative works from, scrape, or use the Content for commercial purposes, including to train machine-learning or artificial-intelligence models, without our prior written permission. Requests for permission may be sent to info@kushheavenfest.com.
4. Your submissions
When you send us a message through the contact form or by email (“Submissions”), you represent that you have the right to share it and that it is accurate and lawful. You grant us a non-exclusive, royalty-free, worldwide license to use, copy and store your Submissions in order to respond to you and operate our business. Please do not send confidential information, unsolicited creative ideas or anything you are not comfortable with us storing.
5. Email updates
By signing up you consent to receive emails from Kush Heaven about the event and related announcements. You may unsubscribe at any time by replying “unsubscribe” or emailing info@kushheavenfest.com. See our Privacy Policy for details.
6. Acceptable use
You agree not to: (a) use the Site for any unlawful purpose; (b) send spam, unsolicited commercial messages or false or misleading information; (c) use bots, scrapers or automated tools to access, submit forms on, or extract data from the Site; (d) attempt to interfere with the Site’s security, rate limits or integrity, or to gain unauthorized access to any system or data; (e) impersonate any person or misrepresent your affiliation; (f) upload or transmit malware; or (g) use the Site to harass, threaten or harm anyone.
7. Third-party services and links
The Site links to third-party services such as Instagram, X, TikTok and YouTube and uses third-party providers to operate. We do not control and are not responsible for third-party content, services or policies. Your use of them is at your own risk and subject to their terms.
8. Disclaimers
THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT EVENT INFORMATION WILL BE ACCURATE OR UP TO DATE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KUSH HEAVEN AND ITS OWNERS, ORGANIZERS, AFFILIATES, SPONSORS, PARTNERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). THESE LIMITATIONS APPLY TO THE SITE ONLY; ANY TERMS GOVERNING EVENT ATTENDANCE WILL BE PROVIDED SEPARATELY.
10. Indemnification
You agree to defend, indemnify and hold harmless Kush Heaven and the parties listed above from any claims, damages, losses and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your Submissions, or your violation of these Terms or any law or third-party right.
11. Copyright complaints
If you believe Content on the Site infringes your copyright, send a notice to info@kushheavenfest.com with the subject line “Copyright Notice” that includes: (a) identification of the copyrighted work; (b) identification of the material you claim is infringing and its location on the Site; (c) your name, address, telephone number and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and (f) your physical or electronic signature.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing a claim, you agree to contact us at info@kushheavenfest.com and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their personal jurisdiction, except that either party may seek relief in small-claims court or seek injunctive relief to protect intellectual property in any court of competent jurisdiction. TO THE EXTENT PERMITTED BY LAW, ANY CLAIM MUST BE FILED WITHIN ONE YEAR AFTER IT ARISES OR IT IS PERMANENTLY BARRED.
13. Changes, termination and general terms
We may modify these Terms at any time by posting an updated version with a new effective date; your continued use of the Site after a change means you accept the updated Terms. We may suspend or terminate access to the Site at any time. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and Kush Heaven regarding the Site. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them without restriction.
